Whether you agree with it or not, the fact remains that the Lawsuit and Notice Letter seeking to represent you and other employees have been filed and/or submitted. We feel that the best way to put these matters behind us is to settle with you directly now and litigate only with respect to those current and former employees who do not accept our settlement offer. So even if you have had no problems with payment of your wages, including minimum and overtime wages, your meal periods, your wage statements and final payment of your wages (if applicable), or other potential wage and hour violations, you should not feel bad about accepting the payment we have offered if you are willing to agree to the terms and provisions of the Release Agreement.
A class action lawsuit is a legal action in which one or more plaintiffs sue as representatives of a group of people with similar claims.
Certification means that the court has determined that a class action is an appropriate means to manage and resolve the claims of a group of people.
PAGA is the California Labor Code Private Attorneys General Act, which authorizes aggrieved employees to file lawsuits to recover civil penalties on behalf of themselves, other employees, and the State of California for California Labor Code violations.
Before an aggrieved employee can file a lawsuit to recover civil penalties under PAGA, they must submit a notice to the California Labor and Workforce Development Agency (“LWDA”), and to the employer, of the claimed violations of the California Labor Code and the facts and theories supporting those claimed violations. The LWDA is prescribed a limited amount of time to review the notice and investigate or cite the employer for the alleged violations before an aggrieved employee may file their own suit to seek an award of civil penalties for those violations. Ordinarily, the LWDA does not decide to investigate or become involved in the claimed violations.
